Article 1: AREA OF APPLICATION
All our sales, whether made with a professional or a non-professional, are subject to these general terms and conditions of sale, unless otherwise expressly provided by contract.
Article 2: ORDER
You can place your order via our online sales site (secure transactions via Paypal), by phone or mail, or directly at the Domain. Once the contract has been concluded, the buyer may not, except in cases of force majeure, refuse to accept delivery and must submit any claims as indicated below. The sums paid by the customer constitute a deposit, i.e. an advance on the agreed price (not refundable in the event of cancellation of the sale).
Article 3: Prices
The applicable prices are those shown on the displayed prices. They are ex cellar, transport is at the buyer's expense, unless otherwise provided by contract. Payment is made in cash at the latest on the delivery date. Any payment made after the due date indicated on the invoice will result in the payment of late payment penalties. The amount of these penalties will be equal to one and a half times the legal interest rate. These penalties will be due without formal notice and the costs of recovery will be borne by the buyer.
Article 4: DELIVERY
The transport of our wines is carried out at the buyer's risk, even in the event of a free shipment. The seller cannot be held responsible in case of loss, theft, damage or defective parcel. The customer is required to check the packages as soon as they are received and to notify the carrier of his reservations on the delivery note or at the latest within three days of receipt of the defective package by registered letter.
Article 5: PROPERTY RESERVATION CLAUSE
The goods will remain the property of our company until full payment of the price. In the event of resale of our goods before full payment, the claim resulting from this resale is automatically assigned to us; we therefore reserve the right to inform the sub-purchasers of our products of the assignment of the claim from which we benefit and to proceed to collect the assigned claim. Our right of ownership authorizes us, in the event of non-payment or late payment of a single due date, to repossess our goods after a request made by simple registered letter with acknowledgement of receipt; if necessary, jurisdiction is granted to the Judge of the Referee of the Court within whose jurisdiction the delivered goods are located, to order the buyer to return our company in possession of our goods under penalty payment.
Article 6: ATTRIBUTIVE LAW OF JURISDICTION
Any dispute relating to the sale will fall within the exclusive jurisdiction of the Tribunal de Grande Instance d'Angers, including summary proceedings.
French legislation applies to all our sales.
Article 7: RETRACTATION
In accordance with the provisions of Article L. 121-21 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify any reasons or pay any penalty.
Returns are to be made in their original and complete condition. In this context, you are liable. Any damage suffered by the product on this occasion may be of such a nature as to defeat the right of withdrawal. You are responsible for the return shipping costs.
In the event of exercise of the right of withdrawal, Domaine Vinicole de Chaintres SAS will refund the sums paid within 14 days of notification of your request.
Article 8: PROTECTION OF MINORS
In accordance with article L. 3342-1 of the Public Health Code, the sale of alcoholic beverages to minors is prohibited. The customer declares and undertakes to be 18 years old on the date of the order.
Article 9: WARNING WITH HEALTH CHARACTER
Alcohol abuse is dangerous for your health. Its consumption must be moderate.
Article 10: LEGAL INFORMATION
In accordance with Article 27 of Law No. 78-17 of 6 January 1978, the personal data provided by the customer may give rise to the exercise of the right of access and rectification at the Domaine Vinicole de Chaintres.
In order to meet customer needs and ensure optimal service, Domaine Vinicole de Chaintres is required to record certain personal data (surname, first name, address). This information is intended exclusively for Domaine Vinicole de Chaintres.
Article 11: PROTECTION OF FILES AND DATA
The personal information collected is intended to better respond to requests and process orders. In accordance with the law n°78-17 of 6 January 1978, relating to Information Technology, Files and Liberties, the customer has a right of access, rectification and deletion of data of a personal nature.
